CurbSync Privacy Policy

This Privacy Policy explains how CURBSYNC LLC, a Texas limited liability company ("CurbSync," "Company," "we," "us," or "our"), collects, uses, discloses, and otherwise processes information in connection with the CurbSync website, software, applications, APIs, messaging services, and related services (collectively, the "Service").

By using the Service, you acknowledge the practices described in this Privacy Policy.

1. Scope and Roles

CurbSync provides software and infrastructure to retailers, restaurants, and other businesses ("Customers") that use the Service to manage curbside pickup and communicate with their customers.

When a Customer uses CurbSync to collect or process information about its customers, employees, or other individuals, CurbSync generally processes that information on the Customer's behalf. The Customer is generally responsible for determining what information it collects, why it collects it, and what notices or consents are required.

This Privacy Policy primarily describes CurbSync's own privacy practices. A Customer's own privacy policy may also apply to information that Customer collects or uses.

2. Information We Collect

Depending on how the Service is used, we may collect or receive:

Account and business information

  • name;
  • business or organization name;
  • email address;
  • telephone number;
  • mailing or business address;
  • login credentials and authentication information;
  • billing and subscription information;
  • account preferences;
  • employee and user information; and
  • other information provided during registration or account administration.

Customer and order information

Customers may submit information relating to orders and pickup transactions, which may include:

  • customer name;
  • telephone number;
  • email address;
  • order identifiers;
  • order status;
  • pickup location;
  • arrival or check-in information;
  • order-related communications;
  • appointment or pickup information; and
  • other information that a Customer chooses to process through the Service.

Communications information

We may process SMS, MMS, email, or other communications sent through the Service, including message content, recipient and sender information, delivery information, timestamps, opt-in and opt-out status, and related messaging metadata.

Device and usage information

We may automatically collect information such as IP address, browser type, operating system, device information, approximate location derived from IP address, pages or features accessed, timestamps, referring URLs, diagnostic information, and other technical or usage information.

Payment information

Payments may be processed by third-party payment providers. CurbSync may receive limited transaction information from those providers, such as payment status, billing identifiers, and the last four digits of a payment card, but generally does not receive or store complete payment-card numbers.

3. How We Use Information

We may use information to:

  • provide, operate, maintain, and support the Service;
  • create and manage accounts;
  • authenticate users;
  • process subscriptions and payments;
  • facilitate order and pickup communications;
  • send SMS, MMS, email, and other requested communications;
  • process customer arrival and pickup information;
  • deliver and monitor messages;
  • manage opt-ins and opt-outs;
  • provide customer support;
  • respond to inquiries;
  • detect, prevent, and investigate fraud, abuse, security incidents, and unauthorized activity;
  • troubleshoot and improve the Service;
  • develop new products, features, and services;
  • perform analytics and measure Service usage;
  • comply with legal obligations;
  • enforce our Terms of Use and other agreements;
  • protect the rights, property, safety, and security of CurbSync, our Customers, users, service providers, and others; and
  • perform other purposes disclosed at the time information is collected or otherwise permitted by law.

4. SMS and Mobile Messaging Privacy

CurbSync's messaging functionality is intended primarily to facilitate communications between a Customer and that Customer's customers regarding orders, pickup, arrival, scheduling, and related matters.

Consent

Customers are responsible for obtaining all legally required consent before sending SMS or other messages through CurbSync.

Where SMS consent is required, the recipient should be clearly informed of:

  • the identity of the sender;
  • the purpose and subject matter of the messages;
  • that messages may be recurring where applicable;
  • how to opt out; and
  • that message and data rates may apply.

Consent must be voluntary and may not be obtained through deceptive, misleading, or otherwise prohibited practices.

CurbSync may require Customers to demonstrate or document their consent practices and may restrict messaging where consent cannot be adequately established.

Opting out

Recipients may opt out of recurring SMS messages by replying with standard keywords such as STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT, where supported.

After an opt-out is processed, CurbSync will generally suppress subsequent recurring messages associated with that opt-out, subject to legally permitted or technically necessary communications.

Recipients may be able to receive a single confirmation message acknowledging an opt-out.

Re-subscribing

A recipient who has opted out may provide new express consent to receive messages again where supported. A previous opt-in does not automatically remain valid after an opt-out.

Help

Recipients may reply HELP where supported to request messaging assistance. Customers may also provide their own customer-service contact information.

Message frequency

Message frequency varies according to the Customer's order activity, configuration, and communications practices. CurbSync does not independently determine how often a Customer communicates with its customers.

Message and data rates

Message and data rates may apply. CurbSync is not responsible for fees imposed by a recipient's mobile carrier or telecommunications provider.

Mobile information and marketing

CurbSync does not sell or share mobile telephone numbers, SMS opt-in data, or SMS consent information with third parties or affiliates for their own independent marketing or promotional purposes.

CurbSync may share mobile telephone numbers, messaging content, consent status, and related information with telecommunications carriers, messaging providers, cloud service providers, contractors, and other service providers when reasonably necessary to provide the messaging functionality requested by a Customer or to operate, secure, support, and maintain the Service.

Such service-provider sharing does not constitute a sale of mobile information for independent third-party marketing.

5. How We Share Information

We may disclose information in the following circumstances:

Customers and their users

Information submitted through a Customer's account may be accessible to that Customer and its authorized users according to the Customer's configuration.

For example, when a customer provides a phone number to a retailer or restaurant using CurbSync, that Customer may use the number to send order-related communications through the Service.

Service providers

We may disclose information to vendors and service providers that perform services for us, including:

  • cloud hosting and infrastructure;
  • telecommunications and SMS/MMS delivery;
  • email delivery;
  • payment processing;
  • authentication;
  • analytics;
  • security and fraud prevention;
  • customer support;
  • software development;
  • database and data storage;
  • monitoring;
  • professional services; and
  • other services necessary to operate the business.

These parties may access or process information only as reasonably necessary to perform their services or as otherwise permitted by law.

Business and marketing partners

We may work with affiliates, resellers, referral partners, integration partners, advertising providers, marketing partners, strategic partners, and other businesses.

We may disclose business, account, usage, aggregated, de-identified, and other information to these parties for legitimate business purposes, including operating, promoting, marketing, analyzing, improving, integrating, and expanding CurbSync and its services, subject to applicable law.

We do not sell or share mobile telephone numbers or SMS opt-in/consent information with these partners for their own independent marketing or promotional purposes.

Nothing in this Privacy Policy prevents CurbSync from sharing information with service providers or other parties where necessary to provide a requested service, including messaging delivery.

Corporate transactions

Information may be transferred or disclosed in connection with an actual or proposed merger, acquisition, financing, investment, reorganization, bankruptcy, sale of assets, sale of equity, or other corporate transaction.

Legal and safety purposes

We may disclose information when we reasonably believe disclosure is necessary to:

  • comply with law, regulation, legal process, subpoena, or governmental request;
  • enforce our agreements;
  • protect the rights, property, or safety of CurbSync or others;
  • investigate fraud, abuse, security incidents, or unlawful activity; or
  • prevent imminent harm.

Aggregated and de-identified information

We may create, use, disclose, and commercialize aggregated, statistical, anonymized, or de-identified information that cannot reasonably be used to identify an individual or Customer.

6. Cookies and Similar Technologies

We may use cookies, pixels, local storage, software development kits, logs, and similar technologies to operate the Service, remember preferences, authenticate users, understand usage, maintain security, and improve our products.

Third-party providers may use similar technologies on our behalf.

You may be able to control certain cookies through browser or device settings. Disabling certain technologies may affect functionality.

7. Data Retention

We retain information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Service, maintain business and transaction records, comply with legal obligations, resolve disputes, enforce agreements, prevent fraud, and protect security.

Retention periods vary based on the type of information, the nature of the relationship, Customer requirements, legal requirements, and operational needs.

When information is no longer required, we may delete, aggregate, anonymize, or otherwise dispose of it in accordance with our policies and applicable law.

8. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect information against unauthorized access, loss, misuse, alteration, or disclosure.

No system or method of electronic transmission or storage is completely secure. Accordingly, we cannot guarantee absolute security.

You are responsible for protecting account credentials and for using reasonable security practices when accessing the Service.

9. Data Choices and Privacy Rights

Depending on where you live and subject to applicable exceptions, you may have rights concerning personal information, which may include rights to:

  • request access to personal information;
  • request correction of inaccurate information;
  • request deletion of personal information;
  • request information about how personal information is collected or used;
  • opt out of certain forms of sale, sharing, targeted advertising, or profiling where applicable;
  • limit certain uses of sensitive personal information where applicable; and
  • appeal a decision concerning a privacy request.

These rights vary by jurisdiction and may not apply in every circumstance.

To make a privacy request, contact us at sales@curbsyncapp.com. We may need to verify your identity before completing a request. We may also deny or limit requests where permitted or required by law.

If CurbSync processes information on behalf of a Customer, you may be directed to contact the applicable Customer first. We may assist the Customer in responding to a valid request as required by applicable law and our agreement with that Customer.

We do not discriminate against individuals for exercising privacy rights where prohibited by law.

10. Children's Privacy

The Service is intended for businesses and their customers and is not directed to children under 13.

We do not knowingly collect personal information directly from children under 13. If you believe a child has provided personal information to us in violation of applicable law, please contact us so that we can take appropriate action.

11. Third-Party Services and Links

The Service may integrate with or contain links to third-party services, websites, applications, or platforms.

CurbSync does not control third parties and is not responsible for their privacy practices, security, content, or policies. Your use of third-party services is governed by their applicable terms and privacy policies.

12. International and Cross-Border Processing

CurbSync and its service providers may process information in the United States and other jurisdictions where CurbSync or its service providers operate.

By using the Service, you acknowledge that information may be transferred to jurisdictions that may have different privacy laws than the jurisdiction in which you reside.

We take reasonable steps required by applicable law to protect information transferred across jurisdictions.

13. California and Other State Privacy Laws

Certain U.S. states provide residents with specific privacy rights. CurbSync will provide rights required by applicable state privacy laws, subject to applicable exemptions and limitations.

Where required, additional state-specific notices may be provided.

Nothing in this Privacy Policy is intended to limit any privacy rights that cannot lawfully be limited.

14. Do Not Track

The Service may not respond to browser "Do Not Track" signals or similar mechanisms unless required by applicable law.

15. Changes to This Privacy Policy

We may update this Privacy Policy periodically.

If we make changes, we may post the revised policy through the Service or on our website and update the effective date. Your continued use of the Service after an updated policy becomes effective constitutes acknowledgment of the revised policy to the extent permitted by law.
